These General Terms and Conditions (“GTC”) of Scribershub GmbH, Hochallee 103, 20149 Hamburg (“scribershub” or “we” or “us”) apply to the relationship between scribershub and writers. They govern the use of the scribershub platform (“Platform”), accessible at the URL scribershub.com, and the matching of writers with clients seeking writing services.
With our platform, we offer you, the "writer", the opportunity to be connected as a professional creator of text content, such as a freelance journalist, advertising copywriter, public relations writer, corporate publishing writer, author or screenwriter ("writer"), for the creation of corresponding content (texts, audiovisual content etc., hereinafter: "Content") within the framework of a "project".
Scribershub acts as an advisory intermediary between the writer and the "writing client", i.e., content-interested entities or companies of all kinds, such as publishers, press offices, communications departments, public relations agencies, corporate publishing agencies or advertising agencies for a project.
Registration on our platform is free. If a consulting and placement agreement is successfully concluded between us and a writer seeking a writer, the writer will receive a commission if we present them with suitable candidates. Writers incur no costs, even in the event of a successful placement.
The platform is exclusively for entrepreneurs as defined in § 14 of the German Civil Code (BGB). Any differing terms and conditions of the writer shall only apply if scribershub expressly agrees to them in writing.
Only adults who independently create content can register as writers on scribershub. Writers who are not self-employed and consumers cannot register.
Separate terms and conditions apply for those seeking writing services.
The accessibility of our platform via the internet does not constitute a legally binding offer to conclude a contract. You can register as a writer on our platform by accessing the relevant section and entering the required information. This includes your full name, an email address, and a password of your choosing. You are obligated to keep this password secret and not to disclose or make it accessible to third parties.
By clicking the "Register" button, you will initiate the process of joining our curated network for writers. Until you click the button, you can cancel the registration or change the information you provided in accordance with section 2.1 at any time.
We will then send a confirmation email to the address you provided. This email will contain a confirmation link. You must click this link to ensure that the email address you provided actually belongs to you. After clicking the link, you will be redirected back to the platform and asked to complete your scribershub profile with the required information specified there. This required information includes, among other things:
The uploading or linking of at least two work samples. By uploading or linking, you declare to scribershub that all work samples were written by you. Any co-authors must be identified. You warrant that you possess the necessary rights to make the work samples available to scribershub and shall indemnify scribershub upon first demand against any costs arising from claims by third parties due to the infringement of the aforementioned rights. This indemnification also includes reasonable legal defense costs.
The provision of at least two references, including their email addresses, who have agreed to confirm your references to us upon request and who have expressly permitted you to provide us with their names and contact details for this purpose. scribershub will use the personal data you provide in this regard solely for verifying the references you have listed.

After entering all required information, you can submit it to us by clicking the "Verify Profile" button. This completes your part of the application process for inclusion in our curated network for writers and makes us an offer to add you to our platform.
Scribershub will then promptly review your mandatory information ("Quality Check"). After successful Quality Check, you will receive a welcome email. With this email, we accept the aforementioned offer, and a contract is formed between you and scribershub regarding the use of the platform and inclusion in our curated writer network ("Contract"). If the Quality Check is unsuccessful, you will receive a corresponding email notification from us.
scribershub connects people seeking writing services for projects with the most suitable writers from its curated writer network.
scribershub offers you as a writer the opportunity to be included in our curated writer network free of charge.
If we receive a project request from a writer, we may, at our discretion, identify suitable candidates from our curated network and suggest them to the writer. In this case, and for this purpose, we will share the email address and phone number you provided with the writer. They can then contact you using these methods. Before suggesting any candidates, we will contact those we have identified as suitable for a project using the provided contact information. We will discuss the essential aspects of the project with the candidate in question (such as the writer's desired content and scope, deadlines, budget, etc.) and ascertain their interest in the project.
For the aforementioned purpose, you authorize scribershub to create writer profiles from the content you upload to the platform, particularly from the mandatory information provided. We may also forward these writer profiles to prospective writers to enable them to assess whether you are a suitable partner for a project.
You are not entitled to be suggested by us to a writing client or, if you have been suggested to a writing client, to be contacted or commissioned by them.
Those seeking writers can contact writers using the contact details we provide in accordance with section 3.3 with the aim of concluding a contract for the creation and delivery of content within the framework of a project in accordance with section (“)Project contract“) contact. From this point on, all further communication regarding the project will take place solely between the person seeking writing services and the writer.
scribershub does not under any circumstances act as an agent or messenger between writers and those seeking writing services.
A project contract is solely between the person seeking a writer and the writer. Only the terms and conditions agreed upon between you and the writer for the project contract apply.
No contractual relationship under Section 311 Paragraph 3 of the German Civil Code (BGB) arises between you and scribershub. scribershub expressly disclaims all liability for circumstances relating to the person seeking a writer or for the proper fulfillment of the contract by the writer seeking a writer.
You are not authorized to create multiple profiles.
You are responsible for regularly and independently creating backup copies of the data you store on our platform at appropriate intervals on your own systems.
You are obligated to keep your login details strictly confidential and to protect them from unauthorized access by third parties. If you suspect that your login details have been misused by a third party, you are obligated to inform us immediately and appropriately.
You are required to keep all mandatory information in your profile up to date at all times.
If you lose your self-employed status, you may no longer use scribershub as a placement service and must inform scribershub of this fact immediately, unless your employer permits you to continue self-employed work on the side. In this case, scribershub reserves the right to terminate the contract concluded in accordance with section 2.5, as per section 8.2.
When using the platform, you are also required to:

You agree not to submit any materials or information to scribershub that are unlawful, particularly those that infringe on the intellectual property rights, copyrights, or personal rights of third parties, either when providing the required information or otherwise. You warrant that you possess the necessary rights to provide such materials or information to scribershub and shall indemnify scribershub upon first demand against any costs incurred by third parties due to the infringement of the aforementioned rights. This indemnification also includes reasonable legal defense costs.
You must not provide Scribershub or any writer seeking a writer with any extremist, abusive, immoral, defamatory, or pornographic content. Should a writer seeking a writer request that you create extremist, abusive, immoral, defamatory, or pornographic content for them, you must inform Scribershub immediately.
You agree that contract-related communication between us may take place in electronic form.
Our services are provided free of charge. Therefore, in accordance with legal regulations, we are only liable for intent and gross negligence.
The contract concluded between the writer and scribershub in accordance with section 2.5 is valid for an indefinite period.
The contract may be terminated by either party at any time with 7 days' notice. Notice of termination must be given in written form in accordance with § 126b of the German Civil Code (e.g., email).
The termination of the contract between the writer and scribershub is not relevant to the validity of concluded project contracts.
Scribershub processes your personal data in accordance with applicable data protection laws. Further details can be found in the privacy policy below link.
The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Hamburg.

Scribershub acts as an advisory intermediary between the person seeking writing services and the writer for a project.
Submitting inquiries via our platform is free of charge. If a consulting and placement agreement is concluded in accordance with section 2.5, a commission is payable by the writers seeking employment, as outlined in section 5 below, if we have presented suitable candidates to the writers seeking employment in accordance with sections 3.1 and 3.2.
The platform is exclusively for entrepreneurs as defined in § 14 of the German Civil Code (BGB). Any differing terms and conditions of the writing service user shall only apply if scribershub expressly agrees to them in writing.
Separate terms and conditions apply to writers.
You acknowledge these Terms and Conditions as the contractual basis. The currently applicable Terms and Conditions can be viewed on the platform at any time and can be accessed, saved, and printed from there. scribershub does not store this contract text after the contract is concluded.
If working days are specified as deadlines in these terms and conditions and/or on the platform, these shall be understood to mean all weekdays except Saturdays, Sundays and public holidays in Hamburg or nationwide.
On the scribershub platform, you can submit requests for writers to create content via the corresponding online form or by email (“Inquiry“).
We can only process your request if you have provided the information marked as mandatory in the online form or via email, in particular your first and last name and an email address. Your request should also include a detailed description of the desired content and other important parameters of the project, such as deadlines, desired specializations or language skills of the writer, budget, subject matter, media channel, etc. The more precise your information is in your request, the more accurately we can tailor our writer suggestions to your needs.
Should you require further information before submitting an inquiry, you can contact scribershub via our online form or by email.
By submitting this request, you are initiating the process of concluding a consulting and brokerage agreement under the terms and conditions of these General Terms and Conditions. Upon receiving your request, we will contact you promptly via the communication channels you provided in your request to discuss the essential aspects of your proposed project in a binding mannerProject meeting“). During the project meeting, our fee for the project will also be discussed.
Once the essential aspects of the project and our fee have been discussed, we will send you a binding offer letter by email containing the aforementioned essential aspects of the project as well as our fee. This offer letter remains binding for a maximum of seven (7) business days. You can accept the offer contained therein within this period by sending us a corresponding email. This will establish a legally binding consulting and placement agreement between you, as the client seeking writing services, and usConsulting agreement“) for the project in question.
Once the consulting agreement has been concluded, we will begin working for you. As part of this process, we will first identify suitable candidates for your project from our curated network of registered writers and contact these potential writers to discuss the agreed-upon key aspects of the project and to gauge their interest in the projectSchreiber selection(“). In this context, it may be helpful for us to disclose the identity of the writer to the potential writer candidates. If you do not agree to this, please inform us during the project meeting. Following the writer selection process, we will present you with the suitable writer candidates who have confirmed their interest in the project to us during the selection process (“Writer's suggestion“).
A writer proposal comprises a number of writers, agreed upon with you during the project discussion, who are suitable for your project. The writers we propose will be presented to you in short summaries, including their CVs, relevant qualifications, and writing samples. You will receive the writer proposal electronically at the email address you provided. We strive to send you the writer proposal promptly. We will take all information you provide us with during your inquiry or project discussion into account to the best of our ability. The time required for us to prepare the writer proposal may be longer depending on the specific requirements or specifications you provide in your inquiry.
As part of the writer recommendation, we will also provide you with the contact details of the writers in question. You are responsible for any further direct contact with a writer.
Those seeking writing services can contact writers using the contact details we provide in accordance with section 3.3 with the aim of concluding a contract for the creation and delivery of content within the framework of a project in accordance with section 1.1 (“Project contract“) contact. From this point on, all further communication regarding the project will take place solely between the person seeking a writer and the writer. Scribershub will under no circumstances act as an agent, intermediary, or messenger between writers and those seeking writing services.
A project contract is solely between the person seeking writing services and the writer. Only the terms and conditions agreed upon between you and the writer for the project contract apply.
No contractual relationship under Section 311 Paragraph 3 of the German Civil Code (BGB) arises between you and scribershub. scribershub expressly disclaims all liability for circumstances relating to the writer or the writer's smooth performance of the contract.
The client and the writer are solely responsible for agreeing on the fee to be paid by the client to the writer for the completion of a project, including the payment terms. scribershub does not provide any guidelines in this regard. The client and the writer are exclusively responsible for complying with all legal obligations, including any applicable taxes or social security contributions.
For its consulting and placement services, scribershub receives the fee agreed upon in section 2.4. The client seeking a writer is responsible for paying this fee. It is earned as soon as the client receives the writer proposal from scribershub in accordance with section 3.1. This also applies if the project contract is concluded after the termination of the contractual relationship between the client and scribershub, but with the involvement of our services.
Scribeshub will send the person seeking a writer an invoice along with the writer suggestion. The fee is payable within two weeks of receipt of the invoice to the Scribeshub account specified on the invoice.
The person seeking writing services is obliged to provide scribershub with complete and correct information.
The person seeking a writer is obliged to treat all information received within the framework of the contractual relationship with scribershub, in particular all information relating to writer suggestions and contact details, as confidential and in particular not to pass it on to unauthorized third parties.

Writers should not be contacted for purposes other than initiating contracts for the creation of content;
When submitting an inquiry or otherwise, you agree not to transmit any materials or information to scribershub that are unlawful, in particular because they infringe upon the intellectual property rights, copyrights, or personal rights of third parties. You warrant that you possess the necessary rights to provide such materials or information to scribershub and shall indemnify scribershub upon first demand against any costs arising from claims by third parties due to the infringement of the aforementioned rights. This indemnification also includes reasonable legal defense costs.
All materials from potential writers that we send you as part of the writer proposal process are solely for your internal decision-making purposes regarding writer acceptance. Any further use is prohibited.
The consulting agreement concluded between the writing client and scribershub for a project in accordance with section 2.5 is valid for an indefinite period.
The consulting agreement may be terminated by either party at any time with seven days' notice. Notice of termination must be given in writing in accordance with Section 126b of the German Civil Code (BGB). If the consulting agreement is not terminated, it will be automatically terminated upon conclusion of the project agreement pursuant to Section 4.1. Section 5.2 applies to the conclusion of project agreements after termination of the consulting agreement.
You agree that contract-related communication between us may take place in electronic form.
We are under no circumstances liable for the formation of a project agreement, the provision of services, or the breach of obligations in connection with a project agreement concluded between a writer seeking and a writer. Writers seeking and writers are solely responsible parties to the project agreement and all related communications.
Our liability under our contractual relationship with writers is limited as follows:
This clause does not limit our statutory liability for intent and gross negligence, nor for damages resulting from injury to life, body or health.
In cases of slight negligence, we shall be liable for breaches of a material contractual obligation in cases other than those mentioned in clause (a). A material contractual obligation within the meaning of this clause is an obligation whose fulfillment is essential for the proper performance of the contract and on whose fulfillment the client may therefore regularly rely.
Liability under the preceding paragraph (b) is limited to the typical and foreseeable damage at the time of conclusion of the contract.
The limitations of liability apply accordingly in favor of our employees, agents and vicarious agents.
Any further liability of scribershub is hereby excluded; however, any liability on our part for given guarantees (which would have to be expressly designated as such) and for claims based on the Product Liability Act or in the event of data protection violations remains unaffected.
